Premarital agreements (also known as prenuptial agreements) can serve as important contingency plans for two people who are planning to marry. Although no one expects divorce, couples should seriously consider creating a premarital agreement in order to reduce the legal difficulties and emotional turmoil that could arise if the marriage does not work out. A premarital agreement will help protect both partners assets in the event that the marriage is dissolved by unambiguously establishing the rights of each spouse. For couples who have already wed, post nuptial agreements are similar contracts, which also seek to establish each partners rights and responsibilities clearly in the hopes of avoiding an acrimonious divorce. Post-divorce modifications, on the other hand, involve changing elements of a divorce settlement, such as child custody/support or alimony, after the fact.
